Under former ATSF pay rule 15, an employee who is requested by a Company officer to remain on standby after hours on regularly assigned workdays is to be compensated for the actual hours held, up to a maximum of eight hours held in a 24-hour period.In recent months, BNSF has taken the position one is not entitled to the compensation without a written request from the officer authorizing the standby. Accordingly, for those of you choosing to remain under the ATSF pay rules, we advise you to insist that your supervisor provide an email of his instruction prior to agreeing to remain available for standby after hours on workdays.We will fight to get you proper compensation with or without such documentation.However, having evidence in hand makes the battle a little easier.
